The food delivery platform built for Somerset West, Strand and Gordon's Bay — with honest fees and real support.
1. COMMISSION
The Platform charges 18% commission on each completed order subtotal (excluding the delivery fee and VAT). There is no monthly subscription fee and no setup fee.
2. PAYOUTS
Net earnings (order subtotal less 18% commission) are paid to the Merchant's nominated bank account every Monday via EFT for the previous week's delivered orders.
3. CONTRACT TERM
The initial term is 3 months from the date the Merchant's listing goes live. After the initial term this agreement continues on a month-to-month basis and may be cancelled by either party with 30 days' written notice.
4. PLATFORM OBLIGATIONS
The Platform will: (a) list the Merchant's menu and process customer orders; (b) collect card payments on the Merchant's behalf via PayFast; (c) remit net payouts weekly; (d) provide access to the Merchant app for order management.
5. MERCHANT OBLIGATIONS
The Merchant will: (a) maintain accurate menu pricing and stock availability at all times; (b) prepare orders within the stated preparation time; (c) comply with all applicable health, food safety, and business licence regulations; (d) notify the Platform of any closure or change in trading hours with reasonable notice.
6. INTELLECTUAL PROPERTY
The Merchant grants the Platform a non-exclusive, royalty-free licence to display its trading name, logo, menu, and food photography on the Platform and in marketing materials for the duration of this agreement.
7. LIMITATION OF LIABILITY
The Platform is not liable for: delays caused by third-party couriers; system downtime; or losses arising from inaccurate menu or stock information provided by the Merchant. Either party's liability is limited to the net payout value of the orders in dispute.
8. DISPUTE RESOLUTION
Any dispute that cannot be resolved amicably within 10 business days shall be referred to AFSA arbitration under its standard commercial rules. The seat of arbitration is Cape Town.
9. POPIA COMPLIANCE
Both parties shall process personal data lawfully in accordance with the Protection of Personal Information Act (POPIA, Act 4 of 2013). The Platform is the responsible party for customer personal data collected through the app.
10. GOVERNING LAW
This agreement is governed by the laws of the Republic of South Africa.
